how do i appeal a revoke I1-130. Denied because immigration say my marriage is not valid cuz of waiting period?
Is it really fair to associate a divorce that took place in a different country to the laws in Wisconsin. I feel my right to freedom of choice is been tampered with. My husband was married in his country and get Divorced a month before we get married in WI. we were both ignorant of the Wisconsin laws. However, Immigration denied ma petition on the grounds that my marriage is not valid even though I live with my husband and my family for 3yrs now. Please i need help because the system is driving me crazy. I have had abusive husbands before I meet my current husband. I even went to a point when I want to commit suicide but my present husband gave me hope, love and everything a woman needs in a man. I love him so much and taking him away is like taking my life away. PLEASE HELP ME WITH UR THOUGHTS AS MY LIFE IS ABOUT TO BE TAKEN AWAY BY THE USCIS
It doesn't sound like CIS is ruining your life as much as Wisconsin law may be ruining your plans. I'm sure none of the readers of your question are experts on Wisconsin marriage laws, but if Wisconsin law makes your marriage invalid, there really isn't much that CIS can do about that.
They cannot approve an I-130 for a spouse if the parties to the I-130 are not legally married. In Wisconsin, you need to wait six months after a divorce before remarrying no matter where the divorce took place in.
In a way, it seems that you're aiming at the wrong target. If Wisconsin says your marriage is invalid, that's not CIS's fault. Fortunately, you have a good second husband so it sounds like you will be with the right guy no matter where you end up living.
