i am in singapore i want to file divorce without going to india?
my husband and me are away from each other from 3.5 years now..in feb i am gonna complete 4 years of my marriage.i stayed with him for 6 months.in this 6 mnths my in-laws along wth my husband abused me very badly.my father got me home after knowing that they had locked me in room without giving food for 5 days.i want to know how can i give divorce without going to India.am i able to sign and courier the form where my parents can go and subbmitt it in the court an di can go for the last hearing..pls advice
Yes you can do that by giving power of attorney to any of your relative to represent You along with by giving your Vakalatnamma to an Advocate/lawyer to represent you in the court. The proceeding of divorce if it is file unilaterally is long & time consuming. This may take many years to decide & you will be required to visit & present in court whenever the court orders your for your personal presence, or you have to make your statement on oath etc. As you wish to visit the court only for last hearing will not be so & if on the order of the court you fail to appear in person on any date fixed for it,the court can dismiss your petition for this default. As far the other method of divorce is by joint petition being filled by both parties for divorce by mutual consent. In this case the personal presence is required of both of first date or on first motion as well the second/last date or second motion,then only divorce is granted by the court. You can not seek exemption of your personal presence in this case otherwise your case get dismissed for your non appearance on any of these dates.
