UCMJ- Question about the adultary code.?
The guy I married went active duty (I'm reserve) and he abandoned me and slept with other women. He was abusive to begin with. So I left him for his best friend, and my "husband" requested we stay married so he can get more money. Now I want a divorce, and he's saying that he'll have JAG charge me with adultary since my boyfriend got me pregnant. Is it possible I'll get discharged?
You'll both get fucked for adultery. However you won't be discharged you'll most likely get NJP'd. He could hire a JAG if he wants to but it's not in Military Court jurisdiction. This matter would be in private court. You can hire a real pro and make it all his fault and totally take him to the cleaners and even maybe get him charged for abuse as well. He would most likely get booted for the abuse. Adultery will just get you dropped in rank. However it's up to the CO at your command and his. They can give you a suspended sentence. Which basically means it's down on paper and if you screw up again you'll be dropped in rank.
