Divorce Shared Custody
Can I move out of state while keeping shared Custody?
I live in NC and have been offered a job in another state. I shared custody of my daughter. I am currently in the 1 yr separation period before I can be legally divorce. The custody arrangements are mutual here. If I move do I waive my rights for custody of my daughter? My X will not work with me for custody if I move.
Unless you can convince the Court to amend the temporary custody order to give you full custody, you will be effectively giving up your shared custody and the likelihood of obtaining full custody in the divorce proceeding will be diminished.
The Court is obliged to consider only the "best interests of the child," and not your best interests. Sorry, but that's just the way it is.
