Divorce Nebraska Filing

Can a spouse filing for divorce move to another state with the kids if other spouse in jail - ANY advice will?

and or opinions appreciated. About 13 years ago my husband of almost 9 years did 30 days in jail because he was caught driving with a revoked liscence and he couln't pay the fine, ( Nebraska. ) He was married and had three kids ages 6 to 11. Whle in jail, he was served Divorce Papers and the ex moved to Colorado with the kids. Here's why i'm writing - I recently found out from his oldest child that over the years she'd told the kids if dad loved them he'd come to Colo plus other negative remarks. But prior to us marrying, she'd bring kids halfway to meet,3 to 4 times a year for 2 or 3 weeks.. After marrying,we were lucky to see them every 2 years because we couldnt afford all travel expenses - he's aways paid child support on time,even loaned her 6,000 he had to borrow from his boss. To me, she used kids as a pawn and the youngest hardly speaks to him. He blames himself but i've wondered if taking kids out of state is even legal???

Unfortunately for you, yes as long as she is the custodial parent, she is free to move herself and the children almost anywhere. Here's what I've learned about kids...as they grow older and experience life, they see the games that one parent may have played against the other parent and they tend to be very forgiving toward the absent parent as they begin to assimilate the facts. Also, unfortunately, some women get very bitter against their children's father, especially after he remarries. It's not fair, but it is true. But you two endure through this and in the end righteousness always wins.
