Where should I file for divorce?
My husband moved me from Connecitcut to Virginia. I wanted to give our marriage a second chance but things are getting worse. I 'lived' here in VA for about 3months. I still have a CT drivers license, I pay CT car taxes and such. My name is not on the lease to the apartment. So I am basically a resident of CT. I want to know if I need to file for Custody of our two kids here in VA or CT and file for divorce in VA or CT?
You would file in CT. VA residency law states you must live there for at least 6 months to be considered a resident.
Since you've not fulfilled residency in VA you're still a CT resident and would be required to file there. You would file for divorce and child custody in the same state, your residency state.
