Divorce Green Card

Would my conditional green card be automatically revoked once the divorce is finalized?

I have been married to an American citizen for one year and seven months, and we entered into the marriage in good faith. Because many different reasons, however, we are seeking a divorce.

Right now I have a conditional green card, and I am planning on filing for the waiver to remove the conditions when the marriage is over. But I am planning on a trip to go back to my home country for two months, and I am wondering whether my conditional green card would be automatically revoked once the divorce is finalized. Because if not, I would wait on filing for the waiver until 90 days before the expiration date on my green card.

Thank you!

They will not necessarily revoke it. You'll have to be able to prove that the marriage was in good faith. Depending on the evidence you provide them, they will make the decision to either let you stay, or send you packing. If you and your husband can stay in good terms and if he is willing to help you, a letter from him stating that the marriage was in good faith will help as well.
